Terms of Use

These terms explain the rules that apply when you download, access or use the Echo Notes app, website and related services.

Your memories remain yours You retain ownership of the notes, recordings, photos and other content you create.
Use the app responsibly Do not misuse the service, violate another person’s rights or attempt to disrupt it.
Keep your own safeguards Protect your device and account, and keep suitable copies of memories that are important to you.

1. Agreement to these terms

By downloading, accessing or using Echo Notes, you agree to these Terms of Use. You should also read our Privacy Policy, which explains how personal information is handled.

If you do not agree to these terms, do not use the app or related services. Nothing in these terms limits rights that cannot legally be excluded under applicable consumer law.

Echo Notes is intended to help you record and organise memories. It is not a medical, diagnostic, therapeutic, emergency, legal or professional record-keeping service.

2. Who may use Echo Notes?

You must be legally capable of agreeing to these terms. If you are under the age at which you can enter a contract in your country, a parent or legal guardian must review and agree to these terms on your behalf.

A parent or guardian who permits a child to use Echo Notes is responsible for supervising that use and for helping the child understand privacy, sharing and account security.

3. Licence to use the app

Echo Notes is licensed to you, not sold. Subject to these terms, you receive a personal, limited, non-exclusive, non-transferable and revocable licence to install and use the app on Apple-branded devices that you own or control, in accordance with the Apple Media Services terms and any applicable App Store usage rules.

You must not:

  • copy, distribute, sell, rent, lease, sublicense or commercially exploit the app;
  • reverse engineer, decompile, disassemble or attempt to derive source code, except where law expressly permits it;
  • remove or alter copyright, trade mark or other ownership notices;
  • circumvent technical restrictions, security features or access controls; or
  • use the app to create a competing service by copying substantial features, design or content.

All rights not expressly granted to you are reserved by Echo Notes and its licensors.

4. Your optional account

You can use local features without creating an account. An account may be required for optional private cloud backup, restoration or other online features.

When using an account, you agree to:

  • provide accurate information and keep it reasonably up to date;
  • use an email address you are authorised to access;
  • choose a strong and unique password;
  • keep your login details confidential; and
  • tell us promptly if you suspect unauthorised access.

You are responsible for activity carried out through your account unless the activity occurred because we failed to use reasonable care.

5. Your memories and other content

You retain ownership of the text, recordings, transcripts, photos, names, tags, dates, prompts, Life Books and other content you create or add to Echo Notes.

You grant us a limited licence to host, copy, transmit and process your content only to the extent reasonably necessary to provide features you request, such as cloud backup, restoration, support or an export. This licence ends when the relevant content is deleted, subject to reasonable technical backup cycles and legal retention requirements.

You confirm that:

  • you own your content or have permission to use it;
  • adding, storing or sharing it does not infringe another person’s rights;
  • you will consider the privacy and dignity of people shown or discussed; and
  • you will not knowingly upload unlawful or harmful content to online services.

Echo Notes does not claim ownership of your memories and does not use them to train a generative-AI model.

6. Acceptable use

You must not use Echo Notes or its online services to:

  • break the law or encourage unlawful activity;
  • harass, threaten, exploit, impersonate or abuse another person;
  • store or distribute content that you have no lawful right to use;
  • introduce malware, malicious code or harmful material;
  • probe, scan, overload, disrupt or bypass the security of the app, website or cloud services;
  • automate access in a way that places an unreasonable load on the service;
  • attempt to access another user’s account or backup;
  • misrepresent an association with Echo Notes; or
  • use the service in a way that could harm Echo Notes, users or service providers.

We may investigate suspected misuse and take proportionate action to protect users and the service.

7. App features and generated insights

Patterns, connections and Memory Webs

Echo Notes may identify repeated names, tags, dates or themes using rules within the app. These features are organisational aids. They may be incomplete or inaccurate and should not be treated as factual conclusions, health assessments or professional advice.

Voice transcription

Transcripts can contain mistakes, particularly where audio is unclear, multiple people speak, names are unusual or accents vary. Review important transcripts before relying on or sharing them.

Reminders

Device settings, permissions, battery restrictions, software faults or operating-system behaviour may prevent a reminder from appearing. Do not rely on Echo Notes for urgent, medical, safety-critical or legally important reminders.

Life Books and exports

You are responsible for checking exported documents before printing, publishing or sharing them. Exports may reveal sensitive details about you or other people.

8. Local storage, backups and exports

Echo Notes is local-first. Local information may be lost if your device is damaged, reset, replaced, lost, stolen or if the app is deleted without a usable backup.

Optional private cloud backup is provided as a convenience and is not a guaranteed archival, disaster-recovery or permanent-storage service. Uploads and restoration can fail because of connectivity, storage limits, provider outages, software faults, account problems or corrupted files.

You are responsible for keeping appropriate additional copies of memories that are irreplaceable or especially important. Check that an export or backup is complete before deleting an original.

Never use Echo Notes as the only copy of information that you cannot afford to lose.

9. App Store downloads, purchases and refunds

Echo Notes is distributed through Apple’s App Store. Any price, tax, purchase confirmation, billing, family-sharing eligibility and refund process shown by Apple is handled through your Apple account and is subject to Apple’s applicable terms.

Where you purchase the app or a paid feature through Apple, payment is collected by Apple rather than directly by Echo Notes. Refund requests for App Store transactions should normally be made through Apple’s refund process, without affecting any rights you have under applicable consumer law.

Echo Notes will not introduce a recurring charge without clearly identifying it as a subscription before you agree to purchase it. Any future subscription would also display its price, billing period, renewal terms and cancellation method through the applicable purchase screen.

10. Apple and other third-party services

Some functionality depends on services supplied by others, including Apple, iOS, the App Store, speech recognition, email delivery, website hosting and Supabase authentication, database and storage.

Those services may have their own terms and privacy policies. We are not responsible for a third-party service where the problem is outside our reasonable control, although this does not remove any responsibility we have under law.

Apple-specific acknowledgement

These terms are between you and Echo Notes, not Apple. Echo Notes, rather than Apple, is responsible for the app and its content, subject to these terms. Apple has no obligation to provide maintenance or support services for Echo Notes.

To the maximum extent permitted by law, if the app fails to conform to an applicable warranty, you may notify Apple and Apple may refund the purchase price paid for the app, if any. Apple has no other warranty obligation for the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce the Apple-related provisions against you.

11. Availability, updates and changes

We aim to keep Echo Notes available and functioning, but uninterrupted or error-free operation cannot be guaranteed. We may maintain, update, change, add, remove or discontinue features where reasonably necessary for security, compatibility, legal compliance, service improvement or technical reasons.

Updates may be required to continue using some features. Older devices or operating-system versions may eventually stop being supported. We will aim to avoid materially reducing paid functionality without a valid reason and will respect applicable consumer rights.

12. Important disclaimers

Echo Notes is a personal memory and journalling tool. It does not provide medical advice, mental-health treatment, diagnosis, safeguarding, emergency monitoring, legal advice or professional record storage.

The app may contain mistakes, interruptions or compatibility issues. Features such as transcription, pattern detection, reminders, backup and export depend on your device, permissions, connectivity and third-party services.

Nothing in these terms excludes warranties or remedies that must apply under consumer law. Where the app is supplied as paid digital content, it must meet the standards required by applicable law.

13. Our responsibility to you

We are responsible for losses that are a foreseeable result of our breach of these terms or our failure to use reasonable care and skill. A loss is foreseeable if it was obvious that it would happen or both you and we knew it might happen when you agreed to these terms.

We do not exclude or limit liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your mandatory consumer rights.

Echo Notes is supplied for personal and domestic use. We are not responsible for business losses, loss of profit, loss of revenue, loss of business opportunity or business interruption arising from use of the app for commercial purposes.

We are not responsible for loss caused solely by events outside our reasonable control, your failure to follow reasonable instructions, unsupported modifications, loss of access to your Apple/email account, or deletion of local information without a usable backup.

14. Suspension, account deletion and ending use

You can stop using Echo Notes at any time. You may delete local content, remove optional cloud backup, delete your account through available app controls and uninstall the app.

We may restrict or suspend online features where reasonably necessary to address serious misuse, security threats, unlawful activity, non-payment of an applicable charge, or a material breach of these terms. Where appropriate, we will try to explain the issue and allow a reasonable opportunity to resolve it.

We may permanently close an account for a serious or repeated breach, where required by law, or where continuing the account would expose users or the service to material risk.

Provisions that logically need to continue after termination—including ownership, liability, dispute and governing-law provisions—will remain in effect.

15. Governing law and disputes

These terms are governed by the laws of England and Wales. If you are a consumer living elsewhere in the United Kingdom or another country, you may also benefit from mandatory protections under the laws of the place where you live.

The courts of England and Wales will have non-exclusive jurisdiction. Consumers living in Scotland may generally bring proceedings in Scotland or England and Wales, and consumers living in Northern Ireland may generally bring proceedings in Northern Ireland or England and Wales.

Please contact us first so we can try to resolve a complaint informally.

16. Changes to these terms

We may update these terms to reflect changes to Echo Notes, the law, security requirements or the services we use. The latest version will appear on this page with an updated date.

Where a change materially affects existing users, we will take reasonable steps to provide notice through the app, website or account email before the change takes effect where appropriate.

If any provision is found unlawful or unenforceable, the remaining provisions will continue to apply. A delay in enforcing a right does not waive that right. You may not transfer your rights under these terms without our written agreement, but we may transfer our rights and obligations where this does not reduce your legal protections.
